We the people of the United States, in order to form a more equitable nation, establish true justice for all, provide healthcare for all, eliminate poverty, and secure true freedom for ourselves and our posterity, do establish this Constitution of America which transforms our existing republic, its representative form of democracy, and its fifty-one different ruling governments into a new, untried form of government designed to prevent the evolvement of oligarchies and dictatorships and their inevitable tyranny.

We have agreed in public forum that our New Government shall consist of an affiliation of local governments maintained by residents of each locality and that merely being born in this nation is not enough to claim the benefits of citizenship; that participation in New Government's lawmaking and administrative processes is a duty and not a right, an obligation and not a privilege; that the proposal and passage of laws shall be made solely by the individual citizens affected by such laws when participating within official Committees and Boards, and at the polls. We have agreed that this form of government, as opposed to a larger, traditional regional or "central" government, is the only way to prevent the accumulation of excessive wealth and power and the inevitable abuse of power such a condition spawns. We further agree to name this new nation "America."

All persons born or naturalized in America and subject to its jurisdiction, are citizens of America, and no local or regional Administration shall abridge the privileges or immunities of citizens, nor shall they deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the full protection of laws.

All citizens, when called upon, shall participate in maintaining New Government and shall vote on every issue relevant to their geographic area of residence, or should the subject matter of the issue affect them. All shall be obligated to obtain a level of schooling equal to a four year college education, and as part of that education shall be bestowed with the knowledge and skills necessary to administer New Government. In exchange for fulfilling the obligations and responsibilities of good citizenship throughout their lives, Americans shall enjoy the many benefits of citizenship, such as access to the American Healthcare System and American Retirement Villages, plus any other benefits they collectively deem desirable.

The power of law-making in this New Government shall belong solely to the people, not to political representatives, and the division and structure of New Government shall be instituted on four levels: neighborhood, town or city, region (now known as state), and national.

All laws policies and regulations shall be proposed, deliberated, passed or rejected directly by the citizenry at large or by their official Committees and Boards. Where a law is of relevance to neighborhood, only the resident citizens of the affected neighborhood shall vote upon it; where of relevance to town or city, only resident citizens of the affected town or city shall vote, where of regional relevance, only resident citizens of the affected region shall vote, and where of national relevance, the entire American citizenry shall vote.

All powers of policy creation and law-making shall be vested in the citizens of America individually and collectively as described below in Section 4.

No policy, law, or regulation shall be authorized that deliberately discriminates against any minority group.

At no time shall any collective of American citizens hold the authority to declare war. Only an event in which the land, sea, or air space of the republic has been intruded upon by hostile forces shall the full force of the nation's professional military be used in any way deemed necessary. At no time shall home civil defense forces be sent to foreign lands.

All neighborhood needs shall be officially determined by a Neighborhood Advisory Committee, which shall then report its recommendations to both the Community Planning Board and the Town or City Administration, both of which shall then jointly deliberate and send their recommendations for a bill to the entire affected citizenry for vote.

Creating Bills

Proposed laws, regulations and policies may originate only by a proposal made by an individual citizen, a Neighborhood Advisory Committee, or a Community Planning Board. Suggestions for bills or refinements to citizen, Community Planning Board, and Local Administration proposals may be made by the National Planning Board, but may be rejected by the citizens affected by such a law. No law shall originate in an Administration, whether local, regional, or national.

Passing Bills into Law

All bills shall be voted upon solely by citizens affected by the bill's consequences. Local bills shall be voted upon solely by the citizens of the relevant locality. Regional bills shall be voted upon solely by citizens of the relevant region, and National bills shall be voted upon by all citizens.

Other Matters

The results of all votes shall be collected and stored in an appropriate and safe repository. Votes on local issues shall be stored locally, on regional issues stored regionally, and on national issues stored in a national repository. All repositories shall be public repositories, and records always available to any citizen wishing access.

New Government shall be a bottom-up form of government in which the policies and laws of society are created by the citizens themselves, as opposed to the traditional top-down form of government in which rulers or representatives create policies, and make laws.

Neighborhood Advisory Committee

The basic voice of the American people shall be the Neighborhood Advisory Committee, which shall be comprised of a randomly selected group (by lottery) of ten to fifteen nonpartisan citizens gathered for a minimum of two, and no more than four, days to deliberate, and decide a neighborhood issue(s) or need(s). Committee members shall be reimbursed for income lost and given a daily expense allowance. Each shall be given full information of the issue or need by knowledgeable specialists on the issue. Members of the Committee shall vote only when all fully understand the complexity of the issue or need, and all consequences of their recommended solution(s). Committee recommendations shall be forwarded to the Local Administration and to the Community Planning Board for further action.

Local Administration and Community Planning Board

The Local Administration shall be comprised of ten to fifteen local citizen/decision-makers randomly chosen by lottery for a predetermined period at a predetermined wage, plus paid employees who do the required paper work and record keeping. The Community Planning Board shall be comprised of one or more citizen/specialists knowledgeable of the issue(s) plus five (5) citizen/voters, all randomly chosen by lottery for a predetermined period at a predetermined compensation.

Based upon recommendations of Neighborhood Advisory Committees, the Local Administration jointly with the Community Planning Board, shall deliberate and decide the action(s) to be taken. Should a new law be required, a bill shall be drawn up and sent to the appropriate Regional Planning Board for review to guarantee compliance with regional laws. Together, the Local Administration in conjunction with the Community Planning Board, shall manage the welfare of the community.

The Regional Administration shall be comprised of twenty to twenty-five citizen/decision-makers randomly chosen by lottery for a predetermined period at a predetermined wage, and paid employees who do the required paper work and record keeping. The Regional Planning Board shall be comprised of one or more citizen/specialists knowledgeable of the issue(s) plus five (5) citizen/voters, all randomly chosen by lottery for a predetermined period at a predetermined compensation.

Based upon recommendations made by various Community Planning Boards within their jurisdiction, the Regional Administration and the Regional Planning Board jointly deliberate and decide action(s) to be taken. If a recommendation does not conflict with Regional or National policy or law, it is approved, returned to the Community Planning Board, and a bill submitted for citizen/voter approval. A community bill shall become law only when sixty-five percent of the affected citizen/voters approve it. Should a recommendation be suspected of conflicting with a National law it shall be forwarded to the National Planning Board for review and further action before it is returned to the Community Planning Board. A regional bill may be proposed by the regional Planning Board and shall become law only when sixty-five percent of the affected citizen/voters approve it. Together, the Regional Administration in conjunction with the Regional Planning Board shall manage the welfare of the region.

National Administration and National Planning Board

The National Administration shall be comprised of fifty to seventy-five citizen/decision-makers randomly chosen by lottery for a predetermined period, at a predetermined wage, and paid employees who do the required paper work and record keeping. The National Planning Board shall be comprised of one or more citizen/specialists knowledgeable of the issue(s) plus five citizen/voters randomly chosen by lottery for a predetermined period, at a predetermined compensation.

Based upon recommendations made by the various Regional Planning Boards, the National Administration and the National Planning Board shall jointly deliberate and decide an action(s) to be taken. Should a new national law be required, a bill shall be drawn up to be sent to the voters throughout the nation and shall become law only when sixty-five percent of the citizen/voters approve it.

National Advisory Board

The National Advisory Board shall be comprised of two senior (experienced) members of each of the fifty Regional Planning Boards randomly chosen by lottery for a predetermined period, at a predetermined wage. The function of this one hundred member Board shall be to directly oversee the operation of New Government's International Sector and to make long-range international strategies. The members of the Board shall choose their own chairperson who shall communicate information of international and domestic importance often to the citizenry via Open Forum.
